The travel and leisure industry is evolving at pace. Digitalisation, stricter European rules on consumer protection and package travel, higher sustainability requirements and closer scrutiny by consumer authorities all add complexity. At the same time, new business models are emerging, including virtual tour operating, OTAs, self‑employed travel agents (ZRA), franchise concepts and consolidators. The sector is also facing significant labour market pressures and constantly evolving legislation and regulations in this area.
We advise travel companies and tour operators (online and offline), self‑employed travel consultants (ZRA structures), consolidators, GDS providers, ticketing and platform businesses, hotels and other leisure operators.
We draft and review sector‑specific documentation and advise on existing arrangements. This includes agency agreements, general (travel) terms and conditions, agreements with consolidators, GDS contracts (Sabre, Amadeus, Travelport/Galileo) and IT and platform agreements. We also design and contractually structure franchise systems and ZRA models, and advise on European and national regulation, privacy and consumer law and employment law.
When new structures are being set up, or when discussions escalate into disputes, we support travel organisations in their dealings with bodies such as ANVR, SGR, the Consumentenbond (Dutch Consumers’ Association) and the ACM (Netherlands Authority for Consumers and Markets). We defend travel companies against claims brought by dissatisfied travellers and advise on alleged misleading advertising. In addition, we work with clients on strategic workforce issues – for example, managing flexibility across different types of contracts and dealing with seasonal work – and advise on both individual and collective matters such as dismissals, collective labour agreement issues, false self-employment, internal policies and employee participation/works council matters.
